Arrest memorandum, reasons for arrest during arrest: DG&IG tells Karnataka police

While the recent Supreme Court order states that police arrested the suspect and were charged, the state police chief directed police officers to issue arrest memorandums to the defendant and conduct due diligence when performing the arrest procedures.
Karnataka Police Director General and Inspector General Alok Mohan warned that if police officers make any mistakes, this could be the reason for the court regarding the defendant’s bail.
Recently, there have been several cases where police officers were charged with illegal detention and later arrested, eventually helping the defendants with safe bail.
Having mastered the awareness of the Supreme Court order, Mr. Alok Mohan directed the police to force the arrest memorandum and wrote down the reasons for the arrest. The police should take the signature of the defendant and record the details, rationality and reasons of the arrest to the court.
The notice also warned that police officials concerned would be responsible for disciplinary action if they did not comply with the order and the suspect or defendant was released on bail for lack of arrest procedures.
“Police are following the rules already established in terms of arrests. However, this is another layer of formalities that must be followed. The purpose of the notice is to check the arbitrary use of the right to arrest.”
