Courts can amend arbitral awards, the Supreme Court holds a majority

In a 4:1 majority judgment, the Supreme Court ruled Wednesday that the court could amend the arbitration award under the 1996 Arbitration and Settlement Act. Five judges led by Chief Justice Sanjiv Khanna and three judges (Judges) BR Gavai, Sanjay Kumar and Augustine George Masih, Constitutional Judges agreed to the matter on the contentious and believed that the court had the right to modify the awards by “cautiously.”
CJI Khanna, who wrote for herself and three other judges, said: “The problem with the court is that the court has limited power to amend the arbitration awards under Articles 34 and 37 of the Arbitration and Mediation Act.”
However, Justice KV Viswanathan expressed opposition and held the court could not change the arbitration award.
