Supreme Court rejects petition seeking judicial investigation

The Supreme Court on Thursday refused to accept a plea to demand a team led by retired Apex court judges to investigate the deadly terrorist attack on April 22 in Jamu and Pahalgam in Kashmir that claimed the lives of 26 civilians. A judge led by Justice Surya Kant made a petition filed with the PIL litigant.

“Be responsible before asking such a question. Because when will a retired High Court or Supreme Court judge become an investigative expert? Because when did we (judges) gain expertise in the investigation? We only decide on the dispute. Please do not ask for these prayers (investigation under the supervision of retired SC judges),” said the bench, also including Justice NK NK Singh.

It added: “This is a critical moment for every citizen of the country to fight terrorism. Don’t make any prayers that might make our troops morale. This is unacceptable to us! Look at the sensitivity of the problem.”

The litigant realized that the court was reluctant to accept a request for an investigation into the terrorist attack, and the litigant suddenly raised the issue of Jamu and Kashmir students studying outside the Union territory, while begging him to intend to withdraw other prayers contained in the petition.

The Supreme Court said: “We will not mention anything. Please go anywhere you want to go. Don’t ask us to pass the order! Are you sure of your prayers in the petition? You force us to read all of these (documents) in the evening and you forget your prayers!”

However, the judge led by Kant proposed that prayers related to J&K students studying outside the union territory can be carried out before the jurisdiction HC.

Ultimately, the Apex Court allowed the petitioner to withdraw the PIL but freely granted the relevant High Court approach to the student cause (if any).

Following the deadly terrorist attack in Pahalgam, PIL seeks instructions from the Centre, Chamu and Kashmir Joint Territory Authority, CRPF, NIA and other authorities to prepare an action plan to ensure the safety of citizens of the valley tourist areas.

In addition, the coalition government is requested to seek instructions to form a special investigation team (SIT) to ensure responsibility for terrorist attacks.

Meanwhile, the Director General of the National Bureau of Investigation (NIA) (DG) arrived in Pahalgam on Thursday after the counter-terrorism agency took over the investigation, signed by the Order of Counter-Terrorism and Fighting Initiation (CTCR), the Union Ministry of the Interior (MHA).
