Intercollege transfers can only be ordered with the consent of the faculty: HC

Kerala High Court observed that assistant professors of university assistant professors at Mahatma Gandhi University can only be done with their consent.
Justice N. Nagaresh recently observed during the transfer of Qushatha S. Sangeetha S., whose assistant professor at Devaswom Board Pampa College in Parumala was transferred to DB College in Sasthamcotta. According to the petitioner, inter-university transfers should only be made on written requests from teachers who have completed their service for three years. In the case of the petitioner, the transfer was ordered without her consent.
The court noted that in view of Section 68A of the Mahatma Gandhi University Act of 1985, transfers between universities can only be ordered if consent is obtained from teachers. The petitioner did not make any requests for inter-university transfers. Therefore, transfer is illegal. In addition, the transfer order also has serious consequences. The petitioner will become the majority of teachers in the transfer station.
