All retired HC judges are entitled to full pension regardless of the date of service, rules SC

The Supreme Court ruled on Monday that all retired High Court judges are entitled to full pensions upon retirement, regardless of the date they enter service.

The judge led by CJI BR Gavai believes that any form of discrimination between judges on pension benefits would constitute a violation of Article 14 of the Constitution, which guarantees equality before the law.

The court further clarified that other judges of the High Court are also entitled to full pensions and that for the right to pensions, distinctions should be made between other judges and permanent judges.
