2020 poll violation case: Delhi HC refuses to file lawsuit against Delhi minister Kapil Mishra

The Delhi High Court rejected a trial court lawsuit against City Law Minister Kapil Mishra on Tuesday (18 March 2025) for allegedly making offensive statements and violating the 2020 model code of conduct.
Judge Ravinder Dudeja also sent a notice to Delhi police regarding the BJP leader’s plea, challenging a Sessions court order that dismissed his petition to the subpoena sent him to him in the case.

“There is no need to stop the proceedings. [is] Maintain the necessary conditions for the procedure. The trial court has the freedom to continue to handle the matter. ” said the judge.
The High Court listed the matter for further hearings on May 19.
The matter was listed in the trial court on March 20.

Mr. Mishra posted allegedly offensive statements on social media on January 23, 2020 x Handle Twitter related to Delhi Parliamentary Elections. The returned official filed a complaint against him, who was registered based on FIR.
In an order of March 7, the Sessions Court stated that it had reached a full agreement with the Judicial Court that the complaint filed by the return officer was sufficient to recognize the crimes under Article 125 of the People’s Law (promoting hatred among the classes related to elections).
