They claimed that TCS fired them, but it was linked to colleagues in India, some of whom were using H-1B visas.

This layoff at TCS began during Joe Biden’s presidency and continued under the Donald Trump administration, according to Bloomberg, citing emails and interviews with people familiar with the investigation. The fired employees began complaining against TCS in late 2023.

TCS denies allegations

More than 20 TCS employees have filed complaints about discrimination, Bloomberg reported. However, TC said the allegations were misleading.

The news agency quoted a company spokesperson as saying: “The allegations of illegal discrimination by TCS are useful and misleading.”

“In the United States, TCS has become an equal opportunity employer with the highest level of integrity and values ​​in our operations,” the spokesperson reportedly said.

According to a report by The Guardian earlier this month, complaints from three former TCS workers in the U.S. are similar to those of the Employment Tribunal, saying the company discriminated against it in 2023 based on its age and nationality as part of its layoff program. TC denied such claims before court.

Discrimination affecting Americans

In April 2024, U.S. representative Seth Moulton wrote a letter to the Commissioner of the EEOC and its then-Chairman, Charlotte, Charlotte, asking the agency to consider an investigation into the TCS. He mentioned his Massachusetts resident as more than two dozen people who filed complaints with the agency.

TCS’ actions “may constitute discrimination or practice that affects Americans who fall within the jurisdiction of the EEOC,” he wrote. “In addition, it could also be a potential abuse of the U.S. work visa program designed to fill the U.S. labor shortage.”

With more than 600,000 employees worldwide, TCS may now face an investigation by the EEOC, whose mission is to enforce laws prohibiting discrimination in the workplace.

Workers accuse Milind Lakkad

According to a Bloomberg report, the former worker claimed in the complaint that the shooting happened after TCS global human resources head Milind Lakkad, head of global resources for US companies willing to hire Indian visa workers who lost their jobs in the United States in February 2023.

In an interview with news agency PTI in 2023, Lakkad pointed out that 70% of American employees were American at that time. TCS wants to lower the figure to 50%, he said, as it also “want to provide global opportunities for employees in India”.
