Allahabad HC grants bail, rape states “the victim himself invited trouble”

The Allahabad High Court last month approved a rape charge, noting that the victim himself invited trouble and was also responsible at the same time.
The victim, a master’s student, in her fir tree, said she went to the bar with her friends last September and they were all drinking because she was intoxicated and needed support. She said in a police statement that she had agreed to go to the house where the defendant rested.

She claimed that the defendant was inappropriately petting her on the way, rather than his house in Noida, took her to a relative’s house in Gurgaon and raped her twice. She further claimed that the defendant had touched her inappropriately along the way.
In his bail application, the defendant argued that considering the facts of the case disclosed by the victim, it was not a rape case, but a case with consensus among the parties involved. The defendant’s lawyer also said his client has been struggling in prison since December 2024 and has no criminal history. Therefore, if he is released on bail, he will not abuse his freedom of bail and will cooperate in the early handling of the case.

“The court held that even if the victim’s allegations were accepted as true, it was possible to conclude that she had invited trouble herself and was responsible for the same responsibility. The victim took a similar position in her statement. During her physical examination, her hymen was torn, but the doctor did not comment on the sexual assault,” the opinion of the court, “at the same time, the charge of driving was allowed.”
