Odisha government releases new guide to appoint relatives of late employees

Bhubaneswar: The Odisha government has proposed revised guidelines to handle compassionate appointment cases, thus clarifying pending applications. A notice issued by the General Government and Public Appeals (GA&PG) department on Friday outlined the new approach.
According to the notice, all pending cases of death before the Odisha Civil Service (Rehabilitation Assistance) Rules, effective in 2020, will be handled under the rules that will take effect at the time of employee’s death.
For the commencement of the 2016 amendment rules and deaths before the entry into force of the 2020 rule, the provisions of the Odisha Civil Service (Rehabilitation Assistance) Rules in 1990 will apply.
If a government employee dies before the 2016 amendment rules, the appointment will be processed under the certificate of distress available in the original application and again in accordance with the provisions of 1990.
In addition, for deaths that occurred between the 2010 Amendment Rules and the implementation of the 2020 Rules, the appointment authority must now verify the current financial status of the family. According to Rule 8 of the 1990 Guidelines, the family will be determined by obtaining reports from regional collectors.
The key change is to use the date of death as a decisive factor in the applicable rules rather than considering the date of application.
Advocate General Pitambar Acharya shared his thoughts on development through the formal “X” handle, saying: “The Odisha government’s decision to treat the date of death as an estimated date of a compassionate appointment case is historic. It will resolve hundreds of long-standing cases in the Supreme Court and the Odisha High Court.”
