British court cited Sanjay Bhandari to dismiss another extradition request

In another blow to the Indian government, the British court rejected a request to extradite the defendants charged with alleged involvement in the multi-billion dollar purchase scandal.

On April 11, the British High Court’s February ruling released Sanjay Bhandari, a senior judge (chief magistrate) of England and Wales, rejected the Indian government’s request for extradition to Vikaran Awast.

Quoting the judgment of the British High Court on the Westminster District Court Court, “This position is clear: there is no guarantee that the person who requests will not hold the person who requests (AWAST) in Tihar, or that the court will continue to exist if he is, or if the question raised in Bhandari does not apply to him.
Importantly, the British judge also ruled that the Indian government’s request was issued “abuse of court proceedings because the requesting state (India) attempted to circumvent the ruling against the ruling in the same and same extradition request litigation in the early stages”.

The British court released the case with insufficient evidence against him and a two-year delay in reintroducing the case after the last time the Indian government removed.


In the February ruling, the Indian government’s request to extradite Sanjay Bhandari, the British High Court ruled: “The appellant (bhandari) will face the danger of extortion, accompanied by threats or actual violence or actual violence, other prisoners and/or prison officials.
