Thane’s court grants POCSO bail to charge with evidence of “romantic relationship”; call for detention is unnecessary

Special Judge DS DeShmukh believes that the girl appears to be in a voluntary sexual relationship and appears to be “mature enough to understand the consequences of the act”.
The defendant faces charges under the BNS and POCSO Act.
According to the report, Judge Deshmukh acknowledged the “severity” of the allegations but pointed out evidence of “love” between the two.
The prosecutor’s case began after the girl’s father reported missing. Police found her with a man from the Bhiwandi Wada area, who reportedly said they were in a romantic relationship and had sex from December 25 to 28, 2024.
The court concluded that further detention was unnecessary as the investigation was completed and the charges were filed. In addition, TOI further reported that Judge Deshmukh cited several legal precedents when granting bail. The ruling underlines the complexity of cases involving minors and was approved under the strict POCSO Act.
The court’s emphasis on the girl’s maturity and relationships constitutes the basis for granting bail.
