False promises of marriages have not been tenable in real-time relationships over the years: SC

The Supreme Court ruled that allegations of false promises of marriage were untenable when two adults were engaged in live relationships for many years.

The court said that more and more women are building on-site relationships due to the increase in financial freedom.

The judgment is based on an appeal filed by a man who was accused of having sex with a woman who signed a settlement to confirm their mutual love and intention to marry each other.

The Uttarakhand High Court rejected the man’s defense in the case, and he subsequently brought the Supreme Court to sue.

“We believe that if two capable adults lived together as a living couple for more than a few years and lived with each other, then they would have an assumption that they voluntarily chose the relationship fully aware of its consequences.

In addition, the court held that in a long-standing real-time relationship, there may be situations in which partners express their desire to get married.

“But the expression of desire or desire itself does not indicate that the result of the relationship is the expression of desire or desire,” the court noted.

On-site relationships may not be common a decade or two ago, the court said.

“But now, more and more women are financially independent and capable of making the ability to make life on their own terms. Therefore, when a question of this nature occurs in the court, it shall not adopt tuition fees. ” the court said.

Instead, the court may consider the parties implicitly agree in such a relationship based on the length of such relationship and the length of the conduct of the parties.
