Five years after the 2020 Delhi riot, courts charges of 57 people

A court in Delhi recently ordered a charge against 57 people, arson cases, arson cases, which killed more than 50 people and injured several people in cases related to the 2020 Northeast riots.

Other Conference Judge (ASJ) Pulastya Pramachala said on March 15 that the recorded evidence showed that the defendants were part of the illegal assembly, which was part of an action, and the group’s common goal was to rampage and damage property.

It added that, in line with other articles, they burned a truck, two wheels and warehouses under the “common” goal of the parliament.

The court added: “Article 149 provides that when prosecuting a common object of the Assembly, each member of the Assembly is responsible for the crime committed by any illegal assembly member. Therefore, the arguments on the lack of a specific role in the defense are irrelevant.”

However, the judge dismissed the defendant from the offence of criminal conspiracy, and from the witness’s statement, it is impossible to infer the prior agreement between the defendant and the elements of consent between the others.

The stems come from three FIRs sent by Ashish Tiwari, Shankar Kumar and Shahzada at the Dayalpur police station, who claimed their shop, vehicles and Goddown were burned by mobs during the riots, respectively.
