High Court on SC/ST Cream Layer

Hyderabad: The Telangana High Court on Monday issued a notice directing it to raise a dispute within six weeks in an effort to declare the Telangana booked caste (rationalized booking) bill of 2025 unconstitutional because it does not provide a “cream layer.”
A commander composed of Acting Chief Justice Sujoy Paul and Judge Renuka Yara, is dealing with the petition filed, K. Manga asked the court to direct the state government to provide a “cream layer” for the SC and ST communities in accordance with the ruling of the Supreme Court in Davinder Singh v. Punjab (20255) v. Supreme Court. She said the legislation enacted by the state government violated laws announced by the Supreme Court.
The comic believes that since the legislation does not provide for the “cream layer”, candidates from the SC community that benefit from the reservation will have a “double opportunity” to gain the benefits of the reservation, thus depriving first-generation candidates like her. Therefore, this act violates the principle of real equality.
Akash Kumar, the petitioner’s lawyer, believes that the constitutional judge of the Supreme Court in “Davinder Singh v. Punjab v. Punjab” ruled that subcategories between SC communities were allowed and directed the state to introduce a “cream layer” for reservation. Lawyers have suggested that the state government constitutes a single-person judicial committee led by a retired judge, which also recommends introducing a “cream layer” into bookings between the SC and ST communities.
