Telangana High Court Grand Slam Magistrate Judge, wrongly remanded official

Hyderabad: The Telangana High Court carefully documented the practices of the trial court to approve the remand of the defendants caused by the police without checking whether the rules and procedures were followed, while detaining the defendants.

The High Court did not provide notices in Article 35 of BNSS, in the event of a violation against the offences registered for up to seven years, the police did not comply with the notices under Article 35 of AD.

The High Court received such incidents in the trial court, directing the Registrar (vigilantly) to impose the proper judicial magistrate Karimnagar, strictly in accordance with the law, as the magistrate allowed the remand of the defendant before him, even if the charge of registration of the defendant was less than seven years.

The High Court also directed the Chief of Police Karimnagar to take appropriate action against the investigative officer in the 339/2024 crime, which was registered under the law at the Kosapali Police Station.

The offence is against a registration of a Y. Akhilesh Reddy who lives in the UK, and the offence is a complaint by MEDIPLALE SATYAM of Choppadandi. According to the de facto complainant Satyam, an unknown person called him on a UK phone call on WhatsApp on September 29, 2024, extorted information about his personal issues and demanded Rs 20 lakh. He received a similar call the same day, but did not answer them.

Although no name is mentioned in the copy of the complaint, there are no specific charges against the Satyam caste, the investigator called Akhilesh Reddy the defendant. Police registered cases against defendants under the SC ST Atrocities Prevention Act.

Investigators also booked a ransom case and sent a lookout telescope against Akhilesh Reddy. The moment he arrived at the Bangalore airport. He was remanded in custody when he was released in the District Court.

Defendant attorney Sriramgiri Sharat Kumar informed the court of all details about the issue.

Justice Lackshman condemned Kothapalli’s investigator and the District Court for allowing the defendant to be remanded.
