The Enforcement Bureau (ED) attempted to intervene on Tuesday and opposed the pleas of the brother of City Minister KN Nehru and True Value Homes (TVH) sponsor N. Ravichandran to dismiss the allegation form (CBI) filed against him by the Central Bureau of Investigation (CBI) in a case of suspected bank fraud.
ED Special Attorney N. Ramesh said before Justice M. Nirmal Kumar that the agency conducted an independent investigation based on the CBI case to charge money laundering and hoped to place the materials to help the court decide on Mr. Ravicandran’s Mr. Quarchandran.
NR Elango and Vikram Choudhary, senior legal counsel representing Mr Ravichandran and TVH, opposed the intervention of ED and believed that the latter was neither the complainant nor the victim in the CBI case, and therefore, it did not Locus stands Any intervention in the current revocation process.
Mr Elango insists that the court must submit provisions before allowing ED to intervene in the current Quash petition so that the agency will conduct a money laundering investigation on the petitioner if the High Court eventually revokes the case booked by the CBI.
“Ed’s behavior is that they play the masters of the political masters. What they do is political act, not legal acts. This is not legally allowed, even if they know very well, but to satisfy their political masters, they are doing it. This is unfortunate. This should not happen before the Constitutional Court,” he said.
Mr Choudhary wanted to know whether ED allowed local police to intervene and assist the court in money laundering cases. He said that the ED must be asked to submit an appropriate petition to conduct intervention in this procedure and that this should not be allowed on the basis of verbal requests.
On the other hand, Mr Ramesh denied all charges filed against ED and said the agency had intervened in a number of such cases. “I don’t know why they are afraid of ED intervention,” he said.
CBI Special Attorney K. Srinivasan also spent some time filing a counter affidavit to the Quash petition and handing it over to the court to call on ED to interfere with the proceedings. After hearing all, the judge awarded the time until June 12 to file the intervention petition.
Meanwhile, he awarded the High Court a temporary stay granted by the High Court on 11 December 2024 in all further litigation, which filed the charge form under the CBI.
Justice N. Seshasayee (since retirement) noticed that the CBI had filed a lawsuit against the Quash petitioner’s case to deceive Indian overseas banks to book the case for Rs 3,000 crore, but the petitioner paid off Rs 5,126 crore and fully repayed the loan.
