HC failure WAQF board does not control Ibadat Khana

Hyderabad: Justice Nagesh Bheemapaka of the High Court of Telangana on Thursday failed to comply with the Telangana WAQF board in a court order of December 23, 2024 and directed it to control Ibadat Khana in Darulshifa.

The judge observed that the board’s actions appeared to be targeting poorer areas of the Muslim community and were working for the authoritative people or those directed to them.

Justice Bheemapaka also pointed out that the board of directors essentially ignored the duty to protect the rights of each sub-district in its dedicated manner.

The judge is handling a petition for review filed by Mir Hashain Ali Khan and is challenging the court’s order to control Ibadatkhana.

The court had on December 23, 2024, ordered the board to take control of the Ibadatkhana bearing Municipal No.s 22-2-638, 639, 640, 641, 642, 643, 644, 22-2-645 to 650 and portion of 664, 22-2-664, 22-2-666 and 667, 22-2-636 and 637 and in due course constitution a. The same number of members were occupied in usooli and prevented the decay of eight people. The court also condemned the lawsuit for the 2023 Constitutional Constitutional Constitution, which prohibits Shia women from performing religious functions there. Therefore, the Court has directed the WAQF Board to control the body and to provide opportunities for all denominations of the new committee.

In the December 2024 order, the court also accused the board of directors of the 2018 Mutavali committee of the 2018 Muladhali committee of the forum to remove the then-existing Ibadatkhana and the five mulgies associated with it. The court informed Ibadatkhana that it had been demolished but had not obtained a building permit.

During the inquiry with GHMC, people were inspired when the then president and colleagues conducted residential acceptances at municipal numbers 22-2-645 to 650 to 664, 22-2-664 and other numbers and other numbers and other numbers and other numbers close to GHMC. Personal license for a small amount of land was obtained. The court also notified that there was no meaning to build. They are built by Wakifs to maintain and maintain Ibadat Khana.

One of the committee’s nomination members filed a petition for review in 2023. Senior legal counsel L. Ravichander, who represented him, argued that the court would not issue a writ of such instructions given the available alternative remedies and that the issue should be downgraded to the WAQF Tribunal.

He believes that the Supreme Court has no doubt made it clear that it is not a straightforward petition related to all WAQF matters, first of all, the WAQF Tribunal, the High Court and the Civil Court.

The judge was not satisfied with the argument.

Justice Bheemapaka believes that the actions of the board delayed the court order, enumerating the Quran excerpts, especially the Jasmal Ul Quran of Surah 2; al-baqarah verse 25, recalling the saying of Allah: “Whoever unjustly usurped someone’s land will be surrounded by seven earths.”
