The Supreme Court directed the West Bengal government on Thursday (April 17, 2025) to initiate the recruitment process for assistant teachers, for nine to 12 years, saying its decision was guided by students under the attention of a critical and formative academic year.

The Supreme Court confirmed the complete cancellation of the earlier “pollution” selection process in its April 3 judgment. The judgment affected nearly 24,000 teaching and non-teaching appointments in the state government and auxiliary schools.

“There is a huge clumsiness…we are focusing on the kids,” commented on Thursday (17 April 2025).

The court directed that advertisements for the Assistant Teacher Recruitment Process must be published on or before May 31, 2025. The entire recruitment process should be completed by December 31, 2025.

The judge ordered the state and secondary education authorities to submit an affidavit by May 31 and to close the advertising and schedule of the entire recruitment process until December 31.

The court warned that if the state fails to publish an advertisement and then submit an affidavit, a “appropriate” order will be passed.

The bench noted that the number of contaminated candidates during the earlier selection process was “significantly higher”, and the bench said students should not suffer from fraud.

The recruitment conducted by the West Bengal School Services Council (WBSSC) in 2016 is related to the job recruitment “scam” in cash schools. SSC provided assistant teachers with the selection process for grades 9 to 12 and non-teachers in 2016.

On April 22 last year, the High Court ordered that all 23,123 appointed teaching and non-teaching personnel be voided, whether contaminated or not.

The Supreme Court has agreed to the High Court’s ruling that the selection process has been manipulated and fraudulent and deceived. Attempts to cover up fraud, this fraud only obscures the credibility and legitimacy of its selection process.

Chief Justice Khanna, who wrote the judgment, declared that the entire selection process was invalid even if there were no particularly contaminated candidates. The Supreme Court said the serious violations and violations found during the selection process violated Articles 14 (right to equality) and Articles 16 (right to equal public employment opportunities).

West Bengal is close to the Supreme Court, arguing that the High Court acts in the wrong way without isolating and examining the merits of each person by mechanically canceling all appointments.

The state argues that the sudden termination of 23,123 teaching and non-teaching personnel has put school education in trouble. The education system itself threatens virtual stagnation.
