SC Instructs the Center to set up special POCSO courts first

The Supreme Court on Thursday directed the Centre to set up a specialized POCSO court on a “priority basis” to specifically deal with sexual crimes against children. Judges for Bela M Trivedi and PB Varale said that due to insufficient number of exclusive courts to protect children from sexual offences (POCSO) ACT cases, the timetable for completing the trial as required by law was not followed.

“Therefore, it is expected that the Indian and state governments should take appropriate steps to sensitive officials related to investigating POCSO cases and create a dedicated court to prioritize POCSO cases,” the bench said.

The Supreme Court further directs fees submitted during the mandatory period stipulated by law, in addition to completing trials within the prescribed time frame.
The Supreme Court noted that although most states comply with the instructions of the POCSO courts in the central funding in Tamil Nadu, Bihar, Bihar, Uttar Pradesh, West Bengal, Odisha, Maharashtra and several other states and other cases.

The Supreme Court has previously directed senior defense attorneys and court law firms to v Giri and senior defense attorney Uttara Babbar to submit state wisdom details about the status of POCSO courts.


The Supreme Court heard a petition highlighting the “shocking number of reported child rape incidents” in the SUO MOTU case. The Supreme Court requires states to establish two designated courts in pending child abuse cases under the POCSO Act, more than 300.

It made it clear that under the POCSO Act, a court was established in each district in July 2019, meaning that designated courts can only handle such cases under the law.
