SC maintains CBI detection order against Kerala CM’s top assistant KM Abraham

The Supreme Court on Wednesday retained an order directing the CBI to file a lawsuit against Kerala Chief Secretary-General Pinarayi Vijayan and investigate in disproportionate asset cases. A case by Dipankardatta and Manmohan. Chief Secretary.

R Basant, a senior advocate who appeared in Abraham, filed a FIR under the Corruption Prevention Act and therefore cannot register without compulsory sanctions under Section 17A of the law. The Kerala High Court ordered a CBI investigation into Abraham on April 11, with a plea filed by activist Jomon Puthenpurackal.

The High Court observed a careful analysis of the preliminary inquiry report, other materials, and Abraham’s defense “approximately suggest that his possession of “movable and immovable property is disproportionate to his known sources of income.”

The investigation conducted by the Vigilance and Anti-Corruption Bureau (VACB) on this issue will not “express confidence in the public” and the credibility of its inquiries is “suspicious”. The High Court emphasized a fair, honest and complete investigation to preserve public confidence in the impartial work of state institutions, and the High Court insisted on conducting an investigation in the CBI.

In its handover to the central investigative body, the High Court laid aside the order of the 2017 Inquiry Commission’s special committee judge in Thiruvananthapuram, who rejected the petitioner’s complaint against Abraham. The order is “unjust, completely unreasonable”.

The High Court said the special judge should appreciate the petitioner’s dispute over the various properties acquired by Abraham, which were not considered by the VACB interrogation officer. It added: “The method adopted by the special judge is unacceptable.”

During his service, the petitioner alleged that during his service, Abraham acquired an apartment worth Rs 3 crore in Mumbai, a apartment worth Rs 1 crore, in Thycaud, Thiruvananthapuram, and built a three-story shopping mall worth Rs 8 crore in Kadappakkada, Kollam District. Abraham denied all the charges.
