SC Relief as “uncontaminated fired teacher” extends term to December 31

New Delhi | Kolkata: In a major relief, the Supreme Court expanded the services of terminated teachers and found that the services of teachers without CBI were terminated until December 31. A seat composed of CJI Sanjiv Khanna and Justice Sanjay Kumar believes that teaching in various states and auxiliary schools that the submission of West Bengal will terminate has had an adverse impact.

The order was based on the request of the state government, which moved the Supreme Court after the April 3 judgment. On Thursday, the SC bench noted the submissions submitted by the state government that new recruitment will take time.

SC said it will only provide services to uncontaminated teachers, but will not apply to C and D employees of the state government by state and auxiliary schools.
“We tend to accept the prayers in this application, which are related to assistant teachers, namely the assistant teachers of the 9-10th class and 11-12th year,” CJI said. When listing conditions, advertisements for fresh recruitment should be posted on or before May 31, and the entire process, including the exam, should be completed by December 31.

“In terms of new recruitment, the order will not have any special rights or advantages for the above-mentioned teachers,” CJI added. The SC requires the state and its school service committee to submit a compliance affidavit on or before May 31.


West Bengal CM Mamata Banerjee called the order a “great relief” and said she would take further legal advice on the matter. “It’s a big relief. We’ve had time until December. I urged teachers to do their jobs. I want them not to worry. We’ll find a solution this year.”
