SC resumes conviction of Jawan, who opens fire in chaos

New Delhi: The Supreme Court restored the conviction of an Army bus, who used AK-47 to fire at his compatriots after complaining about the mess of food, overturned the 2014 acquittal of the Himaal Pradesh High Court.
On Thursday, Justices Pankaj Mithal and Svn Bhatti’s judges restored the trial court’s 2013 judgment that found soldiers guilty of attempted murder (IPC Article 307) and illegal use of weapons (ARMS ACT Article 27). “The defendant opened fire in anger and knew that the bullet could lead to death,” the trial said.
While confirming the culprit, the court reduced its sentence from seven years of strict imprisonment to 17 months already in service, citing the incident’s 2010 wine and Jawan’s temporary “angry”, albeit part of the discipline.
The order canceled the High Court’s July 2014 ruling that shelved the conviction and sentence.
