Pakistani woman Seema Haider made headlines in 2023 as he illegally crossed India with her lover Sachin Meena and gave birth to a baby girl on March 18, 2025, but the child’s citizenship was questioned due to Seema’s illegal entry into India.

Seema from Sindh Province, Pakistan, stood out from India through Nepal in May 2023 without a visa or passport. She was arrested and later released on bail after revealing her secret. Seema later married Sachin and began living with him in Greater Noida.

Is Seema Haider’s daughter Indian? What does the law say?

Under the Citizenship Act, children born in India with foreign parents will not automatically obtain Indian citizenship if their parents enter India illegally. Seema’s illegal entry into India means her child does not meet the standards of Indian nationality at birth.

Senior Supreme Court lawyer Rudra Vikram Singh said Seema’s children will not be able to obtain Indian citizenship unless they are proven to be legal to enter India. Article 3 c(ii) of the Citizenship Act clearly states that at the time of the birth of a child, one parent should be an Indian citizen and the other should not live in India illegally.

According to the report from the on-site Hindustan, Sachin’s lawyer AP Singh claimed that Seema had married Sachin in Nepal before entering India, making her an Indian citizen. However, this claim has not been ruled by the court. AP Singh also submitted a petition to the president of Seema Haider.

The case highlights the complexity of Indian citizenship regulations, especially with regard to foreign nationals entering the country illegally. The fate of Seema’s children and her own citizenship remains uncertain until the outcome of the court case.
