Telangana HC pulls up GHMC in Manikonda Jagir, Illegal Buildings of HMDA

Hyderabad: The Telangana High Court on Tuesday raised the GHMC and HMDA Commissioner for failing to implement a court order directing officials to stop officials from stopping illegal and unauthorized buildings in Manikonda Jagir, Mandal, Gandipet Mandal, Rangareddy area.

On March 14, 2023, the Court directed the GHMC and HMDA Commissioners and other relevant authorities to maintain the status quo on the land by preventing any further construction. The court directed them to submit photos and videos on that date.

Despite specific instructions, several structures appear in the subject property, and GHMC and HDMA have not taken effective steps to prevent illegal and unauthorized structures. The court also attracted attention, with the active condolence of GHMC officials, many buildings were carried out in violation of the Greater Hyderabad City Court Act of 1955, exceeding the permissible restrictions.

GHMC believes it has seized 14 buildings and is considering further action to stop illegal buildings. After comparing the photos and status of 2023, the court noted that the illegal and unauthorized buildings were being completed at the time and that some new buildings were underway.

Judge CV Bhaskar Reddy regards the failure to implement a court order as contempt and violations that will require strict litigation.

Before taking steps to issue a contempt order, the judge directed the GHMC and photos and videos of the total number of existing buildings on the disputed land to submit detailed reports and videos. The court also sought information on the number of constructions granted to the license and the number of constructions not obtained any permits.

The Court also directed the Commissioner to report on the number of buildings submitted by departing from approved plans and actions initiated against illegal and unauthorized buildings under the GHMC provisions.

Justice Bhaskar tried to know the number of letters that had been called to the Electricity and Water Supply Department to disconnect the electricity and water supply in the hope of unauthorized construction. The court also requested information on actions taken by officials who failed to prevent illegal and unauthorized buildings or those who obtained such building permits.

The report should be submitted on or before July 2. If the department does not submit a report, the GHMC specialist must appear on the same day to explain the reasons for the non-compliance.
