Telangana HC withdraws retirement from disabled employees

Hyderabad: Justice Nagesh Bheemapaka of the High Court of Telangana canceled the retirement order issued by Andhra Pradesh Vika Ragra Cheese Partnership (APVCC) against seven visually challenged employees, believing that the termination violated the principles of natural justice and due legal proceedings. The judge directed the immediate resumption of petitioners, as well as comprehensive wages, continuity of services and pension benefits. The judge is dealing with a writ plea filed by Cirikonda Mallesh and six others, who argued that they were hired by the APVCC as early as 1987 and 1990 and were forced to retire by an order of November 25, 2012, citing an age-determined report that allegedly placed it over the age of 60.

The petitioners believe that they retire without prior notice and that the medical age verification process lacks scientific rigor and transparency. The petitioner claimed that they had undergone a medical examination at Ottomania General Hospital in August 2012 but had not learned that their long-term accepted date of birth was recorded in their service register at the time of joining. The judge observed that the company failed to provide employees with any display notice or opportunity before issuing a retirement order. According to the suspicious medical report, a unilateral decision is considered arbitrary and legally unsustainable. Respondents defended their lawsuit, claiming that the petitioner’s original appointment was irregular and carried out without proper approval or compliance with recruitment norms. However, the judge noted that no personal investigation or fraud charge was established against the petitioner and that its service records (including the date of birth) have been accepted and taken for more than twenty years.

Telangana High Court Justice Venugopal filed a written petition challenging the inaction of sports and other authorities to conduct fair and transparent elections to the Telangana Fence Association. The judge is hearing a written petition filed by private employee and senior international fencingist M. Mukender. The petitioner attacked the defendant authorities for failing to act in accordance with their representatives, demanding elections to be carried out under their constitution for elections to the Trungana Fencing Association. The petitioner claimed that the existing committee operated without an effective mission and engaged in preferences, including conspiring with select participants outside the state of Tlangana, thus depriving local players of equal opportunity. The petitioner claims that there has not been a fair election yet and that players from several districts are being eliminated, contrary to the statewide goal of promoting the sport. The petitioner sought instructions from the respondents, including the Tlangana Provincial Olympics, the Tlangana State Sports Authority and the Indian Fencing Association to consider his representatives and transparent elections in accordance with prescribed procedures. The judge released the matter for further hearing.
