A California man said the county mistakenly put him under protection, he is fighting for the rights of his 92-year-old father – and not allowing him to spend his last day with his family.

The family now claims that the county has placed the elderly father under protection to cover up medical negligence and control his financial situation.
The process started the motion after a hospital visit last year led to a family giving up his wrong allegation – accusing they strongly denied it when trying to take him home.

“These people can bring your father, your grandmother, your mom, anyone with your loved ones. Howard’s only son Andrew added that this could happen to anyone, often involving money. “That’s what they want.”
Both Andrew and Cynthia claimed that Ventura County increased unnecessary medical expenses by transferring Howard between care facilities.
“When I saw the first bill, I surfaced me,” Cynthia said. “Sanitation homes are more expensive than the nursing homes we use in Santa Barbara, and the care is shocking – they have 129 cases of abuse of seniors there. ”

Andrew also said he is now worried that the county will occupy the apartments in the family life “just to pay those bills and we don’t even owe the bills.”
He explained that the Ventura County Superior Court established the protection after the judge heard testimony and evidence of his condition.
But when Andrew spoke at a hearing on September 24, he said Judge Roger L Lund denied his request.
Meanwhile, county counsel Mitchell Davis admitted he had never reviewed his father’s files — but he still expressed his willingness to issue protection if Howard returned to the hospital.
The second month, Andrew said Jude Lund held another hearing – but included only county witnesses and omitted testimony from his father’s patient advocate.
The worried son claimed that the doctor, Dr. Daniel Cox, who did speak, said Andrew put his father in palliative care without his consent – and then could not reconcile the nurse’s conflict with himself.
He said when he asked for a speech, Judge Lund threatened to withdraw him from the court and grant temporary protection administration and suspended his mother’s 1999 power of attorney.
County officials allegedly defended the father’s need for feeding tubes, although Howard reportedly passed the only test.

Andrew and Cynthia said they have since requested multiple independent assessments – an assessment the county has denied each time. They also said the county denied their request for a face-to-face meeting.
However, a county spokesman claimed the family was represented by an attorney who was allowed to cross-check witnesses and could provide evidence to the court.
“All actions taken by protectors and protectors have been under the supervision of the court and continue to be subject to supervision of the court,” the spokesperson said.
“Andrew Rose and his mother recently made a series of demands to the county for themselves and Howard Rose to seek financial compensation. The county is reviewing these claims.”
Meanwhile, Andrew said several agencies are reviewing cases of potential fraud.
“The pattern of Judge Lund granting protection without reviewing the power of attorney or ensuring due process echoes similar complaints from other families,” Andrew told the news station.
He said the family is now seeking Howard’s return home, “an independent medical assessment as required by conservation guidelines” and “transparency regarding the county’s financial arrangements with nursing homes and doctors.”
