Unauthorized sublease of TN property will be registered as a criminal case: DGP of Madras High Court

Tamil Nadu Police Commissioner/Police Force Chief Shankar Jiwal (DGP/HOPF) has informed the Madras High Court that the tenant will eventually direct all police officers in the state to register the first information report (FIR) without the landlord’s consent.

Government advocate (criminal aspect) Justice SSSSSSS jagadish Chandira issued a notice to DGP/HOPF instructing all police officers in the state not to review the landlord as a sublease complaint in civil disputes, but to register the FIR under appropriate legal provisions.

The lawsuit was filed after the judge recognized a novel tactic of crimes adopted by many criminals who rented immovable property by pretending to be real tenants and then leased it to third parties at a higher quantity without the landlord’s consent.

The judge also pointed out that when the landlord knew of the violation, the culprit skillfully gave civil color to the criminal offense and fled all the money, and then escaped the shackles of the law by leaving the landlord and the sub-tenant to fight in the civil court together in the civil court.

After calling for statistics, Judge Chandira found that 40 cases involving 67 victims were pending at the Greater Chennai City Police Department, affected by 342 victims in the Tambaram committee, 20 victims and 1,020 victims in the Avadi committee before the economic crime party.

Overall, the amount of fraud was nearly Rs 6.5 billion, with some of the cases waiting since 2013. Therefore, the judge asked state prosecutor Hasan Mohamed Jinnah to bring the problem to DGP/HOPF and to find a solution to the problem by preventing the vulnerable land from being deceived.

So, he was told Tuesday (April 22, 2025) that in addition to the announcement, DGP has taken steps to create video information to increase visibility among the public and to get them to circulate on social media.

After watching the video, Justice Chandira asked the broadcast media to spread widely on TV channels and insisted on spreading it to social media to prevent people from dropping their prey on fraudulent people in the future.

He also recorded the court’s appreciation for Mr. Jinnah, Mr. Jiwal and Mr. Shankar.
