Why there is no fir in the judge’s house case? Asked Vice President Dhankhar

Vice President Jagdeep Dhankhar challenged the lack of FIR on Thursday (April 17, 2025) when he found a cash burn case in the High Court judge’s residence, wondering if “out of the legal category” makes the prosecution “out of the legal category” exempt.

The Supreme Court ordered an investigation into a small piece of cash allegedly found from the residence of Judge Yashwant Varma after a fire broke out on March 14 on a winter night. Justice Varma has now returned from the Delhi High Court to his parents’ High Court in Allahabad.

Mr Dhankhar also questioned the legal status of the three judges’ panel and conducted an internal investigation into the matter.

He said every Indian pays great attention.

“If the incident happened in his (ordinary man) house, then the speed would be an electronic rocket. Now, it’s not even a bull cart.”

Mr Dankhar said that although the three judges’ committees are investigating the matter, the investigation is the field of the executives, not the judiciary.

He said the committee has not been established under the constitution or law.

“What can the committee do? The committee can make recommendations at most. To whom?

“The only action we can take on the type of judges’ mechanisms is the parliament (by dismissal),” he said.

The committee’s report said Mr. Dankar said: “The inherent lack of legal status”.

“It’s been a month now. Even a can of worms, even if there are bones in the cabinet, it’s time to blow up the can, and it’s time to cover the lid and the cabinet collapses. Let the worms and bones be carried out in the public realm for cleaning.

He said no one knew about the incident in seven days.

“We have to ask ourselves questions. Is it an explanation of the delay? Can it be combined? Doesn’t it ask some basic questions? In any ordinary situation, the situation will be different.”

He said the incident was confirmed by the Supreme Court and it was obvious that an investigation was needed.

“Now, the country is waiting to breathe. This country is quiet because one of our institutions, people always look up with the highest respect and respect,” he said.

He stressed the importance of the rule of law, and he explained its direction in the democratic purity of its criminal justice system.

He said that due to the lack of FIR, no investigation was currently under the law.

“The law of the land is that every cognizable crime must be reported to the police and failed to report, and that cognizable crime is a crime. So, all of you will want to know why there is no FIR,” he said.

Mr Dankhar pointed out that registration of anyone, any constitutional staff, including the Vice President, could be carried out.

“A person only needs to activate the rule of law. No permission is required. However, if it is a judge, you cannot register for the FIR directly. It must be approved by the judicial officers concerned.”

He stressed that the Constitution only prosecutes the president and the governor.

“So, how do categories outside the scope of the law obtain this immunity?” he wondered.

The Vice President stressed the importance of transparency, referring to the Lokpal bench decision, which has jurisdiction to investigate corruption complaints against high court judges.

He said that he grasped the Sioux perception and the Supreme Court retained the order on the grounds of independence of the judiciary.

“This independence is not protection. This independence is not some kind of indestructible cover for inquiry, investigation or investigation.

“The institution has flourished with transparency and has conducted investigations. The most reliable way to revoke an institution or an individual is to give full assurance, no inquiry, no review, no investigation, no investigation,” Mr Dhankhar said.
