Work case of West Bengal Schools: State Education Department filed a Con-dependence petition before Kolkata HC

On April 23, the West Bengal Ministry of Education’s Ministry of Education raised a petition related to the Supreme Court’s order in the Kolkata High Court, which claimed the maintainability of the petition claimed that the state worked in about 26,000 schools in the state.

The petitioner argues that the Ministry of Education has not yet provided OMR paper for 26,000 teaching and non-teaching positions affected by the Supreme Court ruling, which upheld certain adjustments to the High Court.

During the proceedings, lawyers from the Ministry of Education addressed the judges of Justice Debangsu Basak and MD Shabbar Rashidi and asserted that any petition for contempt should be attributed to the Supreme Court itself due to changes to some of the Supreme Court’s directives.
Similarly, the legal representative of the West Bengal School Services Commission (SSC) also made a claim for legality, namely, to submit the application to the High Court on the same grounds.

On the other hand, the petitioner’s lawyers believe that it is indeed possible to file a petition for despise in the High Court, because the amendment of the Supreme Court did not significantly change the directions originally formulated by the High Court.


The court plans to hold another hearing on the upcoming Monday. The petitioner expressed dissatisfaction with the High Court’s violation of the ruling on April 22, 2024, and subsequently revised this on April 3 and April 17 this year. They filed a petition for contempt in response that the OMR card stored on three hard drives was not uploaded to the West Bengal School Services Commission (SSC) website “Immediately”, which is required by the department’s public access order.
