The Ernakulam bench of the Kerala Administrative Court (KAT) shelved an order issued by the Director of General Education (DGE) on March 11, which deployed staff-based staff-fixed high school teachers who overdiscovered other teachers with or near the area and transferred to the area to overload the teachers in other teachers in these areas to accommodate excess teachers in the area.

Kat directed the General Education Department and DGE to continue general transfers for the 2025-26 academic year, which provides all teachers with the opportunity to participate in general transfers.

The court said the vacancy identification process should be carried out again and a new timetable should be developed for each step in the general transfer process published.

The petitioner argued that there was no reason to transfer them to accommodate the excess teacher. The extra teachers should be transferred to other areas.

Kate said the general education department debate additional secretary said that if the general transfer is not completed at the beginning of the school year, the legal rights of teachers will be affected.

According to a 2017 government order, general transfers in the resort sector (such as the general education sector) should be completed by August 31 to facilitate the transfer of teachers based on student strength and staffing.

During the 2023-24 and 2024-25 academic years, teachers are allowed to find that excess people continue to do excessive negligence without work, thus bringing a heavy financial burden to the Ministry of Finance.

Kat said DGE's order was Malafide. The standards for promoting/transfer principals cannot be followed in the deployment of abandoned teachers.

Kat clarified that DGE is the competent authority for teacher appointments, transfers and positions.

Kerala’s infrastructure and educational technology (Kite) is just an institution that provides technical support for the promotion of transfers. Its CEO (CEO) was not a party to the case before the court, insisting that the teachers responsible in the school transferred to cannot be included in the general transfer.

However, if all teachers (including too many) have the opportunity to participate in the general transfer, the general transfer process will be more fair and appropriate.

The court noted that while it continued not to object to the execution of the DGE order and to retain applications to announce orders, the CEO of Kite issued a circular containing guidance for the deployment/transfer of teachers to submit applications for transfers.

Kat said it was a “executive” action by the CEO of Kite, interfering with the transfer norms that he was simply not competent, calling for appropriate steps to oppose such actions.
