HC rejects real estate company’s request to sell disputed land

Hyderabad: Telangana High Court Justice NV Shravan Kumar dismissed the plea of real estate company Jana Chaitanya Housing Pvt. Limited, requesting instructions to the Registration Department to submit the sales deeds for the three plots submitted in the investigation of Manikonda Jagir No. 250.

On Manikonda Jagir between the WAQF Board and the Government, there is a ownership dispute on the land, about 1,654 acres. The Supreme Court declared the land belonging to the state government and TGIIC in 2022.

Despite the 2006 Errrata notice by the WAQF Board of Directors claiming that the land was a HMDA regional official at Serilingampally, the proceedings of the January 8, 2013 approved the unapproved layout/picture of the unapproved 250/Part/Part and 251/Part, located in Manikonda Jagir. It is worth noting that the Supreme Court revoked the board’s errata notice (date 13.03.2006) on February 7, 2022 and ruled that the 1,654 acres of land, 32 acres, 32 Guntas belong to the state, and the state is exempt from any burden.

Their land was approved with the land regularization program, and the real estate company contacted the registration department for sale deeds. The sub-register of the fence refused on the grounds that the land was on the forbidden list.

Justice Shravan Kumar was reluctant to give any relief and said that the petitioner was a private party without rights or interests in the typical property. The court also noted that the petitioner did not file any documents/deeds for sale in favor of his claim.
