Kerala Chief Minister Pinarayi Vijayan Chief Secretary KM Abraham tagged a “deeply rooted plot” to signal his financial doubts in the public’s mind and undermined his credibility as a cabinet-style official of the Left Democratic Front (LDF) government.

Mr. Abraham, former Chief Secretary of Kerala, ordered the Central Bureau of Investigation (CBI) to file charges against Mr. Vijayan’s petition in the Kerala High Court to re-invest the disproportionate asset case against him.

The High Court has ordered an investigation under the Criminal Miscellaneous Cases (CMC) filed by Jomon Puthenpurackal.

Abraham also demanded an investigation into alleged conspiracy raised by “mercenaries” acting on behalf of the heads of two public sector departments (PSUs), who committed serious financial misconduct in 2014 when he served as additional finance minister.

Mr. Abraham pointed out that an anti-corruption court rejected the illegal accumulation of wealth cases initiated by the “conspirators” against him in 2018. However, the “planner” filed a trial court order to the High Court by bringing criminal miscellaneous cases.

He claimed that the accomplice tried to circumvent the trial court’s plea in the High Court by making additional prayers for the CBI inquiry.

Mr. Abraham argued that the High Court judges who ruled the criminal miscellaneous petition could not order a CBI investigation. The law grants judges the power to grant written petitions.

“Forum Shopping”

He accused the petitioner of “forum shopping”, an euphemism that required the court to hear the case to obtain a favorable outcome.

Mr. Abraham pointed out that it was “disturbing” that the judge chose to listen to the petitioners despite the changes in the judicial lineup.

He said, “Procedural misconduct poses a serious threat to the institutional sanctity and impartiality of the judiciary.”

Mr. Abraham mentioned that the High Court had marked his wife’s bank transactions as “imagined reasons” to ask the CBI without citing a specific reason.

Mr. Abraham claimed that the litigants were motivated by “personal vendetta” rather than by the public interest. He noted that he prevented Mr. Puthenpurackal from “illegal retention” of rooms in Ernakulam’s PWD Resthouse by “threatening” employees and “not paying rent.” Mr Puthenpurackal dismissed the allegation as false.

Furthermore, Abraham quoted Lok Ayukta’s observation in 2005, which said: “It is obvious that his (Mr. Puthenpurackal)’s main hobby is to file public interest litigation with improper motivation.”

After the High Court ruling, Mr. Abraham accused Mr. Plynbrakel and his contributors of “make happiness” and publicly devalued him on live television.

He also submitted detailed instructions to Mr. Vijayan about his assets, bank transactions and liabilities.
