What does the law say?
If the pilot enters enemy territory after being rescued from the plane, it is considered a “Hors de Combat”, which means they are no longer actively involved in the battle and cannot be attacked. This is an international law that is implemented by the Geneva Convention.
The Geneva Convention is an international treaty that governs war. It prohibits attacks on those who surrender or are no longer able to fight, emphasizing humane treatment of war prisoners and those who are not engaged in combat.
This rule ensures that there is no unnecessary pain and escalation due to the non-compliance of the rules. If an enemy state attacks a bailed pilot, it will be considered an “act of war” that leads to prolonged conflict and several other consequences.
